Ce premier volume de l’étude de Soudabeh Marin nous apprend qui est Ostad Elahi, en le replaçant notamment dans sa généalogie et dans l’univers dont il est l’héritier, et nous expose sa philosophie dans ses rapports avec la notion de droit. This first volume of Soudabeh Marin's study tells us who Ostad Elahi was, notably by placing him in his genealogy and the universe of which he was the heir, and sets out his philosophy for its relationship with the notion of law.

par Soudabeh Marin. — Magistrat, philosophe et musicien iranien contemporain, Ostad Elahi est né le 11 septembre 1895 dans la province du Kermânshâh à l’Ouest de l’Iran. Héritier d’une longue tradition spirituelle kurde empreinte de motifs pythagoriciens et néoplatoniciens, Ostad Elahi a d’abord vécu dans un contexte particulier marqué par la retraite et la contemplation. Toutefois, à l’âge de 34 ans (1929), cet ascète érudit quitte sa région natale pour Téhéran, la capitale, et rejoint la vie active pour devenir juge à 39 ans (1934). Ce parcours à l’envers, qui plonge Ostad Elahi dans un environnement hostile voire périlleux pour un mystique, en étonne plus d’un. Il est néanmoins sous-tendu par une stratégie volontaire et spécifique qui consiste à mettre en jeu, dans l’arène de la modernité, une construction philosophique minutieusement éprouvée et (ré)actualisée. Cette anthropologie spirituelle fine, riche et originale regroupe à la fois une métaphysique, fondée elle-même sur une philosophie du droit, une physique, une cosmologie, une psychologie et une éthique à vocation universelle. Fidèle à la tradition spéculative des philosophes et des mystiques et à celle des moralistes d’obédience aristotélicienne de son pays, Ostad Elahi, à travers une illustration contemporaine de la vie philosophique, prône la réalisation de l’homme, finalité même de sa conception du perfectionnement de l’âme. Soudabeh MARIN, 2 Ostad Elahi et la modernité : Droit, philosophie et magistrature en IranCet ouvrage constitue le second volume de l’étude de Soudabeh Marin consacrée à Ostad Elahi (1895-1974). Dans le premier volume, l’auteur nous avait laissé sur la décision d’Ostad Elahi d’entrer dans la vie active pour mieux connaître l’articulation des droits et devoirs de l’homme au contact de la société : il s’agit d’examiner ce qui en suivra. Nous sommes alors invités à suivre les efforts entrepris par ce mystique au service de la Justice, au niveau individuel et plus particulièrement à travers son parcours au sein de la magistrature dans un pays s'attelant à se moderniser. This book constitutes the second volume of Soudabeh Marin's study on Ostad Elahi (1895-1974). In the first volume, we learned about his life until his decision to start an active life inside society to improve his knowledge of the rights and duties of human beings; we are now to know what happened next. It is about following the struggles of this mystic in the service of Justice, on an individual scale and more particularly through his career as magistrate in a country which is itself struggling to modernize itself.

Témoin de la réception des codifications napoléoniennes en Iran, il fait partie de la première génération des juges laïcs officiant au sein de l’appareil judiciaire des Pahlavi, une institution réformée en 1927 sous la houlette de Reza Shah. Le parcours d’Ostad Elahi nous donne l’occasion de découvrir des fonctions variées au sein des différentes provinces iraniennes et permet de mettre en exergue les difficultés liées à la rencontre du droit français et de la shari’a imamite à travers l’entreprise de codification initiée au début du XXe siècle. L’appréhension par Ostad Elahi du jugement moderne, dans le cadre d’une justice d’État conçue sur le modèle français, ne manque pas de soulever les questions relatives à la conscience du juge, à l’équité, à l’intime conviction mais également à la spiritualité de l’acte judiciaire. À travers l’exemple d’Ostad Elahi, il apparaît qu’au sein d’une société donnée, en l’occurrence ici celle de l’Iran moderne, le processus de juridicisation nécessite la prise en compte des tensions et des évolutions culturelles, religieuses, politiques et sociales. Une approche anthropologique du droit exige donc une véritable réflexion sur le sens et la pertinence des parcours individuels dont les discours, les pratiques et les représentations révèlent l’existence de systèmes précis et construits de normes et de valeurs. Mīr Dāmād (d. 1041/1631), philosopher and mujtahid. Spiritual authority and legal authority in Shīʿi Safavid Iran. Studies on Twelver Shīʿism, particularly in the context of Safavid Iran (907-1134 / 1501-1722), are characterized by a dichotomy between the emphasis on law and that on philosophy, reflecting the duality between both the exoteric and esoteric dimensions of this religion. Based on this observation, this article presents a corpus of known and lesser known texts of Mīr Dāmād (d. 1041/1631), a philosophy master and super- mujtahid at the court of the Shāhs in Esfahan, in order to analyse the link between these two facets of his personality and shed some light on the relationship between legal and spiritual authorities in modern Shīʾism. The first part of this paper studies Mīr Dāmād’s portrait in the Shīʿi prosopographical sources. The second part deals with his legal works, notably his fatwās on Friday prayer and defensive jihād. The third part analyses the doxographic notice devoted to Mīr Dāmād by his former student Quṭb al-Dīn Ashkevarī (d. between 1088 and 1095 /1677 and 1684), which weaves legal, philosophical and mystical texts authored by his teacher. This study will show that in the view of Mīr Dāmād and his disciples, the temporal authority of the jurisconsult, during the period of Great Occultation, remained inseparable from the spiritual authority of the Gnostic (ʿārif), whose metaphysical knowledge was both rationally proven and mystically experienced.

This article focuses on the method of transmission in aḫbār belonging to the Arabic literary genre of love prose. The survey of the system of quotations in thirteen love treatises written between the 4th/10th and the 11th/17th centuries indicates that the traditional isnād, in which the names of the transmitters are included, was progressively abandoned. Authors starting from Muġulṭāy (d. 762/1361) chose instead to favour quotations of books by their titles, even though the preferred method of transmitting knowledge was still oral during the Mamluk period. Use of written 'references' not only indicates a formal change of conventional practice, but also implies the willingness of later authors to claim a kind of authorship in reshaping stories taken from old material.
