The recent Department of Labor final rule that raised the salary thresholds for certain overtime exemptions under the Fair Labor Standards Act (FLSA) has several implications for employers: 𝐈𝐧𝐜𝐫𝐞𝐚𝐬𝐞𝐬 𝐭𝐡𝐞 𝐌𝐢𝐧𝐢𝐦𝐮𝐦 𝐒𝐚𝐥𝐚𝐫𝐲 𝐫𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬 𝐟𝐨𝐫 𝐄𝐱𝐞𝐦𝐩𝐭𝐢𝐨𝐧𝐬: The salary threshold for executive, administrative, and professional exemptions is currently $684 per week, or $35,568 per year, which as of July 1, 2024, will increase the minimum salary to $844 per week, or $43,888 per year. The final rule also increases the “highly compensated employee” threshold from $107,432 per year to $132,964 per year. Beginning January 1, 2025, the final rule will increase the threshold for these exemptions to $1,128 per week or $58,656 per year and increase the “highly compensated employee threshold” to $151,164 per year. This will continue to increase on July 1, 2027, and every three years afterward. 𝐄𝐦𝐩𝐥𝐨𝐲𝐞𝐫𝐬’ 𝐂𝐨𝐦𝐩𝐥𝐢𝐚𝐧𝐜𝐞 𝐑𝐞𝐬𝐩𝐨𝐧𝐬𝐢𝐛𝐢𝐥𝐢𝐭𝐲: Employers need to regularly review their current exempt employees’ salaries to ensure they meet or exceed the minimum salary thresholds in compliance with the new final rule. This also is a good time for employers to review the job duties for each position to ensure compliance with the requirements for specific applicable exemptions and resolve any misclassifications. 𝐋𝐞𝐠𝐚𝐥 𝐑𝐢𝐬𝐤𝐬: Failure to comply with the new ruling exposes employers to significant legal and financial risk, including fines, penalties, multiple damages (double wages/overtime under the FLSA and treble wages/overtime under the Massachusetts Wage Act), legal fees, and lawsuits. It is essential for employers to stay informed about labor laws and regulations and to take proactive steps to ensure compliance. Employers should carefully review the final rule, assess its impact on their operations, and take appropriate measures to ensure compliance while mitigating any potential risks. A busy day in Employment Law! The DOL released its final rules concerning overtime today. The final rule includes an increase to the exemption salary threshold, changing from $684 per week ($35,568 annually for a full-year hourly worker) to $1,128 per week (or $58,656 annually). For highly compensated employees, the new EAP salary threshold was increased from $107,432 annually to $151,164 annually. Additionally, the final rule will include a three-year automatic adjustment mechanism to update this salary threshold. While the rule is slated to go into effect July 1, 2024, organizations will have until Jan.1, 2025 to comply with the rule. Link to the Final Rule in the comments below.
