§ 1.
Lovens formål er å styrke menneskerettighetenes stilling i norsk rett.

Følgende konvensjoner skal gjelde som norsk lov i den utstrekning de er bindende for Norge:

Bestemmelsene i konvensjoner og protokoller som er nevnt i § 2 skal ved motstrid gå foran bestemmelser i annen lovgivning.

Convention for the Protection of Human Rights and Fundamental Freedoms1
Rome, 4 November 1950

The governments signatory hereto, being members of the Council of Europe,
Considering the Universal Declaration of Human Rights proclaimed by the General Assembly of the United Nations on 10th December 1948;
Considering that this Declaration aims at securing the universal and effective recognition and observance of the Rights therein declared;
Considering that the aim of the Council of Europe is the achievement of greater unity between its members and that one of the methods by which that aim is to be pursued is the maintenance and further realisation of human rights and fundamental freedoms;
Reaffirming their profound belief in those fundamental freedoms which are the foundation of justice and peace in the world and are best maintained on the one hand by an effective political democracy and on the other by a common understanding and observance of the human rights upon which they depend;
Being resolved, as the governments of European countries which are like-minded and have a common heritage of political traditions, ideals, freedom and the rule of law, to take the first steps for the collective enforcement of certain of the rights stated in the Universal Declaration,
Affirming that the High Contracting Parties, in accordance with the principle of subsidiarity, have the primary responsibility to secure the rights and freedoms defined in this Convention and the Protocols thereto, and that in doing so they enjoy a margin of appreciation, subject to the supervisory jurisdiction of the European Court of Human Rights established by this Convention,
Have agreed as follows:
Art 1.Obligation to respect human rights
The High Contracting Parties shall secure to everyone within their jurisdiction the rights and freedoms defined in Section I of this Convention.

Everyone whose rights and freedoms as set forth in this Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity.

The enjoyment of the rights and freedoms set forth in this Convention shall be secured without discrimination on any ground such as sex, race, colour, language, religion, political or other opinion, national or social origin, association with a national minority, property, birth or other status.

Art 16.Restrictions on political activity of aliens
Nothing in Articles 10, 11 and 14 shall be regarded as preventing the High Contracting Parties from imposing restrictions on the political activity of aliens.

Nothing in this Convention may be interpreted as implying for any State, group or person any right to engage in any activity or perform any act aimed at the destruction of any of the rights and freedoms set forth herein or at their limitation to a greater extent than is provided for in the Convention.
🔗Del paragrafArt 18.Limitation on use of restrictions on rights
The restrictions permitted under this Convention to the said rights and freedoms shall not be applied for any purpose other than those for which they have been prescribed.

Art 19.Establishment of the Court
To ensure the observance of the engagements undertaken by the High Contracting Parties in the Convention and the Protocols thereto, there shall be set up a European Court of Human Rights, hereinafter referred to as «the Court». It shall function on a permanent basis.

Nothing in this Convention shall be construed as limiting or derogating from any of the human rights and fundamental freedoms which may be ensured under the laws of any High Contracting Party or under any other agreement to which it is a Party.

Nothing in this Convention shall prejudice the powers conferred on the Committee of Ministers by the Statute of the Council of Europe.

The High Contracting Parties agree that, except by special agreement, they will not avail themselves of treaties, conventions or declarations in force between them for the purpose of submitting, by way of petition, a dispute arising out of the interpretation or application of this Convention to a means of settlement other than those provided for in this Convention.

Being resolved to take steps to ensure the collective enforcement of certain rights and freedoms other than those already included in Section I of the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4 November 1950 (hereinafter referred to as «the Convention»),
Have agreed as follows:
Art 1.Protection of property
Every natural or legal person is entitled to the peaceful enjoyment of his possessions. No one shall be deprived of his possessions except in the public interest and subject to the conditions provided for by law and by the general principles of international law.
The preceding provisions shall not, however, in any way impair the right of a State to enforce such laws as it deems necessary to control the use of property in accordance with the general interest or to secure the payment of taxes or other contributions or penalties.

No person shall be denied the right to education. In the exercise of any functions which it assumes in relation to education and to teaching, the State shall respect the right of parents to ensure such education and teaching in conformity with their own religious and philosophical convictions.

The High Contracting Parties undertake to hold free elections at reasonable intervals by secret ballot, under conditions which will ensure the free expression of the opinion of the people in the choice of the legislature.

Any High Contracting Party may at the time of signature or ratification or at any time thereafter communicate to the Secretary General of the Council of Europe a declaration stating the extent to which it undertakes that the provisions of the present Protocol shall apply to such of the territories for the international relations of which it is responsible as are named therein.
Any High Contracting Party which has communicated a declaration in virtue of the preceding paragraph may from time to time communicate a further declaration modifying the terms of any former declaration or terminating the application of the provisions of this Protocol in respect of any territory.
A declaration made in accordance with this article shall be deemed to have been made in accordance with paragraph 1 of Article 56 of the Convention.

As between the High Contracting Parties the provisions of Articles 1, 2, 3 and 4 of this Protocol shall be regarded as additional articles to the Convention and all the provisions of the Convention shall apply accordingly.
🔗Del paragrafArt 6.Signature and ratification
This Protocol shall be open for signature by the members of the Council of Europe, who are the signatories of the Convention; it shall be ratified at the same time as or after the ratification of the Convention. It shall enter into force after the deposit of ten instruments of ratification. As regards any signatory ratifying subsequently, the Protocol shall enter into force at the date of the deposit of its instrument of ratification.
The instruments of ratification shall be deposited with the Secretary General of the Council of Europe, who will notify all members of the names of those who have ratified.

Considering that the evolution that has occurred in several member States of the Council of Europe expresses a general tendency in favour of abolition of the death penalty,
Have agreed as follows:
Art 1.Abolition of the death penalty
The death penalty shall be abolished. No one shall be condemned to such penalty or executed.

A State may make provision in its law for the death penalty in respect of acts committed in time of war or of imminent threat of war; such penalty shall be applied only in the instances laid down in the law and in accordance with its provisions. The State shall communicate to the Secretary General of the Council of Europe the relevant provisions of that law.

When a person has by a final decision been convicted of a criminal offence and when subsequently his conviction has been reversed, or he has been pardoned, on the ground that a new or newly discovered fact shows conclusively that there has been a miscarriage of justice, the person who has suffered punishment as a result of such conviction shall be compensated according to the law or the practice of the State concerned, unless it is proved that the non-disclosure of the unknown fact in time is wholly or partly attributable to him.

Art 5.Equality between spouses
Spouses shall enjoy equality of rights and responsibilities of a private law character between them, and in their relations with their children, as to marriage, during marriage and in the event of its dissolution. Convinced that everyone's right to life is a basic value in a democratic society and that the abolition of the death penalty is essential for the protection of this right and for the full recognition of the inherent dignity of all human beings;
Wishing to strengthen the protection of the right to life guaranteed by the Convention for the Protection of Human Rights and Fundamental Freedoms signed at Rome on 4 November 1950 (hereinafter referred to as «the Convention»);
Noting that Protocol No. 6 to the Convention, concerning the Abolition of the Death Penalty, signed at Strasbourg on 28 April 1983, does not exclude the death penalty in respect of acts committed in time of war or of imminent threat of war;
Being resolved to take the final step in order to abolish the death penalty in all circumstances,
Have agreed as follows:

Konvensjon om beskyttelse av menneskerettighetene og de grunnleggende friheter

Undertegnede regjeringer, medlemmer av Europarådet,
som tar i betraktning Verdenserklæringen om menneskerettighetene, kunngjort av De forente nasjoners generalforsamling den 10. desember 1948;
som tar i betraktning at denne erklæringen har som mål å sikre at de rettigheter den fastslår, blir universelt og effektivt anerkjent og etterlevd;
som tar i betraktning at Europarådet har som mål å skape større enhet blant sine medlemmer, og at en av måtene dette mål kan nås på, er å opprettholde og videreføre menneskerettighetene og de grunnleggende friheter;
som på ny bekrefter sin oppriktige tro på disse grunnleggende friheter, som danner grunnlaget for rettferdighet og fred i verden, og som best kan opprettholdes gjennom et effektivt politisk demokrati, og på den annen side gjennom en felles forståelse og etterlevelse av de menneskerettighetene de avhenger av;
idet de som regjeringer i likesinnede europeiske stater med en felles arv av politiske tradisjoner, idealer, frihet og rettsstatsprinsipper, har besluttet å ta de første skritt til en felles gjennomføring av visse av de rettigheter som er uttrykt i Verdenserklæringen;
som bekrefter at de høye Kontraherende Parter, i samsvar med subsidiaritetsprinsippet, har hovedansvaret for å sikre de rettigheter og friheter som er fastlagt i denne konvensjon og dens protokoller, og at de i den forbindelse har en viss skjønnsmargin, underlagt Den europeiske menneskeretsdomstols kontrolljurisdiksjon;

Art 1.Vern om eiendom
Enhver fysisk eller juridisk person har rett til å få nyte sin eiendom i fred. Ingen skal bli fratatt sin eiendom unntatt i det offentliges interesse og på de betingelser som er hjemlet ved lov og ved folkerettens alminnelige prinsipper.
Bestemmelsene ovenfor skal imidlertid ikke på noen måte svekke en stats rett til å håndheve slike lover som den anser nødvendige for å kontrollere at eiendom blir brukt i samsvar med allmennhetens interesse eller for å sikre betaling av skatter eller andre avgifter eller bøter.

Den skal tre i kraft etter at ti ratifikasjonsdokumenter er deponert. For en signatarstat som ratifiserer senere, skal Protokollen tre i kraft den dag dens ratifikasjonsdokument blir deponert.
Ratifikasjonsdokumentene skal deponeres hos Generalsekretæren i Europarådet, som skal underrette alle medlemsstater om hvem som har ratifisert.

The States Parties to the present Covenant,
Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,

Each State Party to the present Covenant which, at the time of becoming a Party, has not been able to secure in its metropolitan territory or other territories under its jurisdiction compulsory primary education, free of charge, undertakes, within two years, to work out and adopt a detailed plan of action for the progressive implementation, within a reasonable number of years, to be fixed in the plan, of the principle of compulsory education free of charge for all.

The States Parties to the present Covenant,

No communication shall be received by the Committee if it concerns a State Party to the Covenant which is not a Party to the present Protocol.

The States Parties to the present Convention,
Considering that, in accordance with the principles proclaimed in the Charter of the United Nations, recognition of the inherent dignity and of the equal and inalienable rights of all members of the human family is the foundation of freedom, justice and peace in the world,
Bearing in mind that the peoples of the United Nations have, in the Charter, reaffirmed their faith in fundamental human rights and in the dignity and worth of the human person, and have determined to promote social progress and better standards of life in larger freedom,

Bearing in mind that the need to extend particular care to the child has been stated in the Geneva Declaration of the Rights of the Child of 1924 and in the Declaration of the Rights of the Child adopted by the General Assembly on 20 November 1959 and recognized in the Universal Declaration of Human Rights, in the International Covenant on Civil and Political Rights (in particular in articles 23 and 24), in the International Covenant on Economic, Social and Cultural Rights (in particular in article 10) and in the statutes and relevant instruments of specialized agencies and international organizations concerned with the welfare of children,

Recognizing that, in all countries in the world, there are children living in exceptionally difficult conditions, and that such children need special consideration,
Taking due account of the importance of the traditions and cultural values of each people for the protection and harmonious development of the child,
Recognizing the importance of international co-operation for improving the living conditions of children in every country, in particular in the developing countries,

The States Parties to the present Protocol,

Reaffirming that the rights of children require special protection, and calling for continuous improvement of the situation of children without distinction, as well as for their development and education in conditions of peace and security,
Disturbed by the harmful and widespread impact of armed conflict on children and the long-term consequences this has for durable peace, security and development,
Condemning the targeting of children in situations of armed conflict and direct attacks on objects protected under international law, including places generally having a significant presence of children, such as schools and hospitals,
Noting the adoption of the Statute of the International Criminal Court and, in particular, its inclusion as a war crime of conscripting or enlisting children under the age of 15 years or using them to participate actively in hostilities in both international and non-international armed conflicts,
Considering, therefore, that to strengthen further the implementation of rights recognized in the Convention on the Rights of the Child there is a need to increase the protection of children from involvement in armed conflict,
Noting that article 1 of the Convention on the Rights of the Child specifies that, for the purposes of that Convention, a child means every human being below the age of 18 years unless, under the law applicable to the child, majority is attained earlier,
Convinced that an optional protocol to the Convention raising the age of possible recruitment of persons into armed forces and their participation in hostilities will contribute effectively to the implementation of the principle that the best interests of the child are to be a primary consideration in all actions concerning children,
Noting that the twenty-sixth international Conference of the Red Cross and Red Crescent in December 1995 recommended, inter alia, that parties to conflict take every feasible step to ensure that children under the age of 18 years do not take part in hostilities,
Welcoming the unanimous adoption, in June 1999, of International Labour Organization Convention No. 182 on the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour, which prohibits, inter alia, forced or compulsory recruitment of children for use in armed conflict,
Condemning with the gravest concern the recruitment, training and use within and across national borders of children in hostilities by armed groups distinct from the armed forces of a State, and recognizing the responsibility of those who recruit, train and use children in this regard,
Recalling the obligation of each party to an armed conflict to abide by the provisions of international humanitarian law,
Stressing that this Protocol is without prejudice to the purposes and principles contained in the Charter of the United Nations, including Article 51, and relevant norms of humanitarian law,
Bearing in mind that conditions of peace and security based on full respect of the purposes and principles contained in the Charter and observance of applicable human rights instruments are indispensable for the full protection of children, in particular during armed conflicts and foreign occupation,
Recognizing the special needs of those children who are particularly vulnerable to recruitment or use in hostilities contrary to this Protocol owing to their economic or social status or gender,
Mindful of the necessity of taking into consideration the economic, social and political root causes of the involvement of children in armed conflicts,

The States Parties to the present Protocol,
Considering that, in order further to achieve the purposes of the Convention on the Rights of the Child and the implementation of its provisions, especially articles 1, 11, 21, 32, 33, 34, 35 and 36, it would be appropriate to extend the measures that States Parties should undertake in order to guarantee the protection of the child from the sale of children, child prostitution and child pornography,
Considering also that the Convention on the Rights of the Child recognizes the right of the child to be protected from economic exploitation and from performing any work that is likely to be hazardous or to interfere with the child's education, or to be harmful to the child's health or physical, mental, spiritual, moral or social development,
Gravely concerned at the significant and increasing international traffic of children for the purpose of the sale of children, child prostitution and child pornography,
Deeply concerned at the widespread and continuing practice of sex tourism, to which children are especially vulnerable, as it directly promotes the sale of children, child prostitution and child pornography,
Recognizing that a number of particularly vulnerable groups, including girl children, are at greater risk of sexual exploitation, and that girl children are disproportionately represented among the sexually exploited,
Concerned about the growing availability of child pornography on the Internet and other evolving technologies, and recalling the International Conference on Combating Child Pornography on the Internet, held in Vienna in 1999, in particular its conclusion calling for the worldwide criminalization of the production, distribution, exportation, transmission, importation, intentional possession and advertising of child pornography, and stressing the importance of closer cooperation and partnership between Governments and the Internet industry,
Believing that the elimination of the sale of children, child prostitution and child pornography will be facilitated by adopting a holistic approach, addressing the contributing factors, including underdevelopment, poverty, economic disparities, inequitable socio-economic structure, dysfunctioning families, lack of education, urban-rural migration, gender discrimination, irresponsible adult sexual behaviour, harmful traditional practices, armed conflicts and trafficking of children,
Believing also that efforts to raise public awareness are needed to reduce consumer demand for the sale of children, child prostitution and child pornography, and believing further in the importance of strengthening global partnership among all actors and of improving law enforcement at the national level,
Noting the provisions of international legal instruments relevant to the protection of children, including the Hague Convention on the Protection of Children and Cooperation in Respect of Inter-Country Adoption, the Hague Convention on the Civil Aspects of International Child Abduction, the Hague Convention on Jurisdiction, Applicable Law, Recognition, Enforcement and Cooperation in Respect of Parental Responsibility and Measures for the Protection of Children, and International Labour Organization Convention No. 182 on the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labour,
Encouraged by the overwhelming support for the Convention on the Rights of the Child, demonstrating the widespread commitment that exists for the promotion and protection of the rights of the child,

I denne konvensjonen menes med barn ethvert menneske under 18 år, hvis ikke barnet blir myndig tidligere etter den lovgivning som gjelder for barnet.

Partene skal treffe alle egnede lovgivningsmessige, administrative og andre tiltak for å gjennomføre de rettigheter som anerkjennes i denne konvensjon. De stater som er part i denne protokoll,
som er oppmuntret av den overveldende støtten Konvensjonen om barnets rettigheter har fått, noe som viser det vidtrekkende engasjement som finnes for å fremme og verne om barnets rettigheter,
som bekrefter på ny at barns rettigheter krever særskilt vern, og oppfordrer til stadig forbedring av barns kår uten forskjellsbehandling, og for deres utvikling og utdanning under fredelige og trygge forhold,
som er foruroliget over de skadelige og omfattende følger væpnet konflikt har på barn og de langsiktige konsekvenser dette har for varig fred, sikkerhet og utvikling,
som fordømmer det faktum at barn er skyteskiver under væpnede konflikter og at det rettes direkte angrep mot mål som er beskyttet etter folkeretten, herunder steder som vanligvis samler et betydelig antall barn, som f.eks. skoler og sykehus,
som merker seg vedtakelsen av Vedtektene for Den internasjonale straffedomstol, og særlig at de definerer det å utskrive eller verve barn under femten år eller å bruke dem til å delta aktivt i fiendtligheter både i internasjonale og ikke-internasjonale væpnede konflikter, som en krigsforbrytelse,
som derfor mener at for å ytterligere styrke gjennomføringen av de rettigheter som er anerkjent i Konvensjonen om barnets rettigheter, er det nødvendig å gi barn bedre beskyttelse mot å bli trukket inn i væpnet konflikt,
som merker seg at artikkel 1 i Konvensjonen om barnets rettigheter presiserer at for så vidt angår den konvensjonen, menes med barn et hvert menneske under 18 år, med mindre myndighetsalder nås tidligere ved lovgivning som gjelder barnet,
som er overbevist om at en valgfri protokoll til konvensjonen som hever aldersgrensen for mulig rekruttering av personer til de væpnede styrker og deres deltakelse i fiendtligheter, vil bidra effektivt til å gjennomføre prinsippet om at ved alle handlinger som vedrører barn skal det først og fremst tas hensyn til hva som gavner barnet best,
som merker seg at Røde Kors og Røde halvmånes tjuesjette internasjonale konferanse i desember 1995 blant annet anbefalte at parter i konflikter skal ta alle gjennomførbare skritt for å sikre at barn under 18 år ikke tar del i fiendtligheter,
som gleder seg over den enstemmige vedtakelsen i juni 1999 av ILO-konvensjon nr. 182 om forbud mot og umiddelbare tiltak for å avskaffe de verste former for barnearbeid, som blant annet forbyr tvungen eller obligatorisk rekruttering av barn for bruk i væpnet konflikt,
som med største uro fordømmer det faktum at væpnede grupper utenfor en stats væpnede styrker rekrutterer, trener og bruker barn i fiendtligheter innenfor og på tvers av nasjonale grenser, og som erkjenner ansvaret som påhviler dem som rekrutterer, trener og bruker barn for dette formål,
som minner om den forpliktelse hver av partene i en væpnet konflikt har til å følge bestemmelsene i internasjonal humanitærrett,
som understreker at denne protokoll ikke har innvirkning på formålene og prinsippene nedfelt i De forente nasjoners pakt, herunder artikkel 51 og relevante normer i humanitærretten,
som er klar over at fred og sikkerhet basert på full respekt for formålene og prinsippene i De forente nasjoners pakt og etterlevelse av gjeldende menneskerettighetsinstrumenter, er helt nødvendig for å sikre barn full beskyttelse, særlig under væpnede konflikter og fremmed okkupasjon,
som erkjenner de særskilte behovene til barn som er særlig utsatt for rekruttering til eller bruk i fiendtligheter i strid med denne protokoll, på grunn av deres økonomiske og sosiale status eller kjønn,
som også er klar over at det er nødvendig å ta i betraktning de økonomiske, sosiale og politiske underliggende årsakene til at barn trekkes inn i væpnede konflikter,
som er overbevist om behovet for å styrke internasjonalt samarbeid ved gjennomføringen av denne protokoll, samt fysisk og psykisk rehabilitering og sosial integrasjon av barn som er offer for væpnede konflikter.

Valgfri protokoll til konvensjon om barnets rettigheter om salg av barn, barneprostitusjon og barnepornografi, 25. mai 2000
De stater som er part i denne protokoll,
som tar i betraktning at for i enda større grad å oppnå formålene med Konvensjonen om barnets rettigheter og styrke gjennomføringen av konvensjonens bestemmelser, særlig artiklene 1, 11, 21, 32, 33, 34, 35 og 36, ville det være hensiktsmessig å utvide de tiltak som partene må iverksette for å sikre at barn vernes mot salg, prostitusjon og pornografi,
som også tar i betraktning at Konvensjonen om barnets rettigheter anerkjenner barnets rett til vern mot økonomisk utbytting og mot å utføre ethvert arbeid som kan være farlig eller til hinder for barnets utdanning, eller skadelig for barnets helse eller fysiske, mentale, åndelige, moralske eller sosiale utvikling.
som er alvorlig bekymret over den betydelige og stigende internasjonale handel med barn med henblikk på salg, prostitusjon og pornografi,
som er dypt bekymret over den omfattende og fortsatte praktiseringen av sexturisme, noe som gjør barn spesielt sårbare fordi den direkte bidrar til salg av barn, barneprostitusjon og barnepornografi,
som erkjenner at enkelte spesielt sårbare grupper, herunder jentebarn, står i større fare for å bli seksuelt utnyttet, og at jentebarn utgjør en uforholdsmessig stor andel av dem som blir seksuelt utnyttet,
som er bekymret over at barnepornografi stadig blir mer tilgjengelig på Internett og annen ny teknologi, og som minner om den internasjonale konferansen om bekjempelse av barnepornografi på Internett (Wien, 1999) og særlig dens konklusjon som ber om en kriminalisering i hele verden av produksjon, distribusjon, eksport, overføring, import, forsettelig besittelse og annonsering av barnepornografi, og som understreker betydningen av et tettere samarbeid og partnerskap mellom regjeringene og Internett-industrien,
som tror det vil bli lettere å eliminere salg av barn, barneprostitusjon og barnepornografi dersom det benyttes en mer helhetlig tilnærming som setter fokus på medvirkende faktorer, herunder underutvikling, fattigdom, økonomiske skjevheter, urettferdig samfunnsøkonomisk struktur, vanskelige familieforhold, mangel på utdanning, migrasjon mellom byer og landdistrikter, kjønnsdiskriminering, uansvarlig seksuell atferd hos voksne, skadelig tradisjonsbestemt praksis, væpnede konflikter og handel med barn,
som tror at for å minske forbrukeres etterspørsel når det gjelder salg av barn, barneprostitusjon og barnepornografi, er det nødvendig å gjøre en innsats for å øke bevisstgjøringen blant folk, og som også tror at det er viktig å styrke globalt partnerskap mellom alle aktører, samt å bedre håndhevingen av lovgivningen på nasjonalt nivå,
som merker seg bestemmelsene i internasjonale rettslige instrumenter om vern av barn, herunder Haag-konvensjonen om vern av barn og samarbeid ved internasjonal adopsjon, Haag-konvensjonen om sivile sider ved internasjonal barnebortføring, Haag-konvensjonen om jurisdiksjon, anvendelig rett, anerkjennelse, fullbyrdelse og samarbeid med hensyn til foreldreansvar og tiltak for vern av barn, samt ILO-konvensjon nr. 182 om forbud mot og umiddelbare tiltak for å avskaffe de verste former for barnearbeid,
som er oppmuntret av den overveldende støtten Konvensjonen om barnets rettigheter har fått, noe som viser det vidtrekkende engasjement som finnes for å fremme og verne om barnets rettigheter,
som erkjenner viktigheten av å gjennomføre bestemmelsene i handlingsprogrammet for forebygging av salg av barn, barneprostitusjon og barnepornografi samt erklæringen og handlingsplanen fra Stockholm-kongressen 1996 mot kommersiell seksuell utnyttelse av barn, og andre relevante beslutninger og anbefalinger fra relevante internasjonale organer,
som tar tilbørlig hensyn til den betydning hvert folks tradisjoner og kulturelle verdier har for barnets beskyttelse og harmoniske utvikling,
er blitt enige om følgende:

Convention on the Elimination of All Forms of Discrimination against Women, 18 December 1979
The States Parties to the present Convention,
Noting that the Charter of the United Nations reaffirms faith in fundamental human rights, in dignity and worth of the human person and in the equal rights of men and women,
Noting that the Universal Declaration of Human Rights affirms the principle of the inadmissibility of discrimination and proclaims that all human beings are born free and equal in dignity and rights and that everyone is entitled to all the rights and freedoms set forth therein, without distinction of any kind, including distinction based on sex,
Noting that the States Parties to the International Covanants on Human Rights have the obligation to ensure the equal right of men and women to enjoy all economic, social, cultural, civil and political rights,
Considering the international conventions concluded under the auspices of the United Nations and the specialized agencies promoting equality of rights of men and women,
Noting also the resolutions, declarations, and recommendations adopted by the United Nations and the specialized agencies promoting equality of rights of men and women,
Concerned, however, that despite these various instruments extensive discrimination against women continues to exist,
Recalling that discrimination against women violates the principles of equality of rights and respect for human dignity, is an obstacle to the participation of women, on equal terms with men, in the political, social, economic and cultural life of their countries, hampers the growth of the prosperity of society and the family and makes more difficult the full development of the potentialities of women in the service of their countries and of humanity,
Concerned that in situations of poverty women have the least access to food, health, education, training and opportunities for employment and other needs,
Convinced that the establishment of the new international economic order based on equity and justice will contribute significantly towards the promotion of equality between men and women,
Emphasizing that the eradication of apartheid, of all forms of racism, racial discrimination, colonialism, neo-colonialism, aggression, foreign occupation and domination and interference in the internal affairs of States is essential to the full enjoyment of the rights of men and women,
Affirming that the strengthening of international peace and security, relaxation of international tension, mutual co-operation among all States irrespective of their social and economic systems, general and complete disarmament, and in particular nuclear disarmament under strict and effective international control, the affirmation of the principles of justice, equality and mutual benefit in relations among countries and the realization of the right of peoples under alien and colonial domination and foreign occupation to selfdetermination and independence, as well as respect for national sovereignty and territorial integrity, will promote social progress and development and as a consequence will contribute to the attainment of full equality between men and women.
Convinced that the full and complete development of a country, the welfare of the world and the cause of peace require the maximum participation of women on equal terms with men in all fields,
Bearing in mind the great contribution of women to the welfare of the family and to the development of society, so far not fully recognized, the social significance of maternity and the role of both parents in the family and in the upbringing of children, and aware that the role of women in procreation should not be a basis for discrimination but that the upbringing of children requires a sharing of responsibility between men and women and society as a whole,
Aware that a change in the traditional role of men as well as the role of women in society and in the family is needed to achieve full equality between men and women,
Determined to implement the principles set forth in the declaration on the Elimination of Discrimination against Women and, for that purpose, to adopt the measures required for the elimination of such discrimination in all its forms and manifestations,
Have agreed on the following:

For the purposes of the present Convention, the term «discrimination against women» shall mean any distinction, exclusion or restriction made on the basis of sex which has the effect or purpose of impairing or nullifying the recognition, enjoyment or exercise by women, irrespective of their marital status, on a basis of equality of men and women, of human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field.

A State Party to the present Protocol («State Party») recognizes the competence of the Committee on the Elimination of Discrimination against Women («the Committee») to receive and consider communications submitted in accordance with article 2.

Communications may be submitted by or on behalf of individuals or groups of individuals, under the jurisdiction of a State Party, claiming to be victims of a violation of any of the rights set forth in the Convention by that State Party. De stater som er part i denne konvensjon,
som merker seg at De forente nasjoners pakt på ny bekrefter troen på de grunnleggende menneskerettigheter, på det enkelte menneskets verdighet og verdi og på like rettigheter for menn og kvinner,
som merker seg at Verdenserklæringen om menneskerettigheter bekrefter prinsippet om at diskriminering er utillatelig og fastslår at alle mennesker er født frie og med samme menneskeverd og menneskerettigheter, og at enhver har krav på alle de rettigheter og friheter som er nevnt i erklæringen, uten forskjell av noen art, heller ikke på grunn av kjønn,
som merker seg at partene i de internasjonale menneskerettighetskonvensjonene er forpliktet til å sikre menn og kvinner lik rett til å nyte alle økonomiske, sosiale, kulturelle, sivile og politiske rettigheter,
som tar i betraktning de internasjonale konvensjoner som er inngått innenfor rammen av De forente nasjoner og særorganisasjonene med sikte på å fremme like rettigheter for menn og kvinner,
som også merker seg de resolusjoner, erklæringer og anbefalinger som De forente nasjoner og særorganisasjonene har vedtatt med sikte på å fremme like rettigheter for menn og kvinner,
som imidlertid er urolige over at kvinner fortsatt er utsatt for betydelig diskriminering, til tross for alle disse ulike instrumentene,
som minner om at diskrimineringen av kvinner bryter med prinsippene om like rettigheter og respekt for menneskeverdet, hindrer kvinner i å delta på lik linje med menn i det politiske, sosiale, økonomiske og kulturelle liv i sine land, er til hinder for økt velferd i samfunn og familie og gjør det vanskeligere for kvinner å utnytte alle sine muligheter, i tjeneste for sitt land og menneskeheten,
som er urolige over det faktum at kvinner i fattige forhold har minimal tilgang til mat, helsetjenester, utdanning, opplæring og sysselsetting, og til å få ivaretatt andre behov,
som er overbevist om at innføringen av den nye økonomiske verdensordning basert på likhet og rettferd i betydelig grad vil bidra til å fremme likestillingen mellom menn og kvinner,
som understreker at det er helt nødvendig å avskaffe apartheid, alle former for rasisme, rasediskriminering, kolonialisme, ny-kolonialisme, aggresjon, fremmed okkupasjon og herredømme og innblanding i staters indre anliggender, for at menn og kvinner skal kunne nyte sine rettigheter fullt ut,
som bekrefter at en styrking av internasjonal fred og sikkerhet, internasjonal avspenning, gjensidig samarbeid mellom alle stater, uavhengig av deres sosiale og økonomiske systemer, generell og fullstendig nedrustning, særlig kjernefysisk nedrustning under streng og effektiv internasjonal kontroll, stadfestelse av prinsippene om rettferd, likhet og gjensidig nytte i forholdet landene imellom, samt virkeliggjøring av retten til selvbestemmelse og uavhengighet for folk som lever under fremmed og kolonialt herredømme og utenlandsk okkupasjon, såvel som respekt for nasjonal suverenitet og territoriell integritet, vil fremme sosial framgang og utvikling, og vil som en følge av dette bidra til full likestilling mellom menn og kvinner,
som er overbevist om at en fullstendig og gjennomgripende utvikling av et land, verdens velferd og fredens sak krever at kvinner deltar maksimalt på alle områder, på lik linje med menn.
som er oppmerksom på kvinnens viktige bidrag til familiens velferd og til samfunnets utvikling, noe som hittil ikke har vært fullt ut anerkjent, morsrollens sosiale betydning og begge foreldres rolle i familien og i oppfostringen av barna, og er klar over at kvinnens rolle i forplantningen ikke bør gi grunnlag for diskriminering, og at oppfostringsansvaret for barn må deles mellom menn og kvinner og samfunnet for øvrig,
som er oppmerksom på at den tradisjonelle manns- og kvinnerollen i samfunn og familie må endres for å oppnå full likestilling mellom menn og kvinner,
som er fast bestemt på å gjennomføre de prinsipper som er nedfelt i erklæringen om avskaffelse av diskriminering av kvinner, og for det formål å vedta de tiltak som er nødvendige for å kunne avskaffe alle former for og utslag av slik diskriminering,
er enige om følgende:

I denne konvensjon menes med uttrykket «diskriminering av kvinner», enhver forskjellsbehandling, utestengning eller begrensning på grunnlag av kjønn som har som virkning eller formål å oppheve eller svekke anerkjennelsen, nytelsen eller utøvelsen av kvinners menneskerettigheter og grunnleggende friheter på det politiske, økonomiske, sosiale, kulturelle, sivile eller ethvert annet område, uavhengig av sivilstatus og med likestilling mellom menn og kvinner som utgangspunkt.

Konvensjonspartene fordømmer alle former for kvinnediskriminering og er enige om å føre en politikk, uten opphold og med alle egnede midler, som tar sikte på å avskaffe alle former for kvinnediskriminering, og for dette formål forplikter de seg til:

De stater som er parter i denne protokoll,
merker seg at FN-pakten bekrefter troen på de grunnleggende menneskerettigheter, på menneskets verdighet og verdi og på like rettigheter for menn og kvinner,
merker seg at Verdenserklæringen om menneskerettighetene (Res 217 A (III)) kunngjør at alle mennesker er født frie og like hva angår verdighet og rettigheter og at enhver er berettiget til alle de rettigheter og friheter som er nedfelt i erklæringen, uten noen som helst forskjell, heller ikke forskjell på grunnlag av kjønn,
minner om at de internasjonale pakter om menneskerettigheter (Res 2200 A (XXI)) og andre internasjonale menneskerettsinstrumenter forbyr diskriminering på grunnlag av kjønn,
minner også om Konvensjonen om å avskaffe alle former for diskriminering mot kvinner («Konvensjonen»), der statene som er parter i den fordømmer diskriminering mot kvinner i alle dens former og er enige om uten opphold å ta alle tjenlige midler i bruk i en politikk for å avskaffe diskriminering mot kvinner,
bekrefter på ny sin vilje til å sikre kvinner den fulle og likeverdige utøvelse av alle menneskerettigheter og grunnleggende friheter og til å treffe effektive tiltak for å hindre brudd på disse rettighetene og frihetene,
er blitt enige om følgende:

En stat som er part i denne protokoll («statspart») anerkjenner at Komiteen for avskaffelse av diskriminering mot kvinner («komiteen») har kompetanse til å motta og behandle henvendelser fremsatt i samsvar med artikkel 2.

Henvendelser kan fremsettes av eller på vegne av enkeltpersoner eller grupper av enkeltpersoner, under en statsparts jurisdiksjon, som hevder å være offer for brudd av statsparten på noen av rettighetene nevnt i Konvensjonen. Dersom en henvendelse er fremsatt på vegne av enkeltpersoner eller grupper av enkeltpersoner, skal dette skje med deres samtykke med mindre representanten kan rettferdiggjøre at hun handler på deres vegne uten slikt samtykke.
