MDEHR is excited to announce a webinar on Tuesday, November 15 at 12pm, with legal experts from Montana and New York, who can speak to insights, lessons, and the impact of having the right to a clean and healthy environment in their respective state constitutions.

Montana was among the earliest states to add a constitutional right to a healthy environment in their state constitution in the 1970's. Roger Sullivan, Senior Partner with McGarvey Law, is a lead attorney for Held vs. Montana, where youth plaintiffs are holding the state of Montana accountable for their role in encouraging fossil fuel use and infringing on their constitutional right to a healthy environment.

New York is the most recent state to amend their state constitution to add the right to a clean and healthy environment. Rebecca Bratspies is a Law Professor at the City University of New York (CUNY) School of Law and the the founding Director of the Center for Urban Environmental Reform. She is an internationally recognized expert on environmental justice, the regulation of new agricultural technologies, and the human right to a healthy environment.

Our moderator for this webinar is Johanna Adashek, Visiting Associate Professor and Environmental Law Fellow at George Washington University Law School. Johanna has written about the need for an environmental rights amendment and presented insights from research of state environmental rights amendment cases for MDEHR in 2020.
