The pandemic has upended work practices over the last 17 months, and under represented lawyers in many cases experienced mostly negative career outcomes, according to our Pandemic Nation research conducted by the ACC Foundation, the Association of Law Firm Diversity Professionals, and the Thomson Reuters Institute in February 2021.     In a July 2020 decision, the EU Court of Justice dealt a blow to international data transfers that invalidated the US Privacy Shield program. The decision also placed upon European data exporters an obligation to ensure adequacy when transferring data under other permissible methods. Our panel will discuss the current state of recommendations and guidance, in the wake of the 2020 decision, the effects of the European Data Protection Board’s comments, and the revised standard clauses on cross-border transfers.

    Post-employment restrictive covenants like non-competes and non-solicitation agreements remain common in many industries even as courts, federal agencies, and state legislatures have taken steps to narrow when these provisions can be enforced. This session will explore recent trends in post-employment restrictions and will focus on what in-house counsel should be aware of when hiring a new employee subject to a restrictive covenant, seeking to enforce a restrictive covenant against a departing employee, reviewing and updating a company’s existing restrictive covenants, and drafting restrictive covenants for new employees.
