Solicitation Description:

SCOPE: Pursuant to Texas Government Code Section 2165.001, Custodianship of State Property, Texas Government Code 2156.121, and Rules and Procedures adopted by the Texas Facilities Commission, the Texas Facilities Commission is requesting responses to this Request for Proposal for Program Management services, consultation, and administrative professional services for Project #22-003-0802 (the Program), for the successful execution and completion of the Texas Border Wall (TBW) construction program or portions of it, including new barrier structure and associated infrastructure as described further in the program description below. 

Background

i) Texas Facilities Commission (TFC) supports state government through strategic planning, asset management, design, construction, operation, maintenance, and leasing of state facilities and the reallocation or disposal of state and federal surplus property.  TFC provides property management, repair, renovation, maintenance services, custodial, grounds, and utility services for a building inventory of nearly 18 million square feet of office space, parking garages, and parking lots. 

ii) On June 1, 2021, the Governor issued a Disaster Declaration for 34 Texas counties near or along the U.S. southern border to provide additional resources and strategies to combat the influx of illegal immigrants as well as the rise in criminal activities, including criminal trespass.  On June 16, 2021, the Governor directed the Texas Facilities Commission to hire a Program Manager to oversee construction of the Texas Border Wall (TBW). The Program Manager(s) will lead the process of planning and executing the program and will oversee procurement of the contractors and subcontractors needed to build the TBW. The Program Manager(s) and contractors will identify State owned lands and willing private landowners to facilitate construction of the TBW along an alignment that supports the Department of Public Safety law enforcement activities. 

iii) TBW Program.  In response to the Governor’s directive, TFC introduces a strategic initiative in 2021 to construct TBW segments on state owned, local government owned, and privately owned property from El Paso to the Gulf Coast. The initiative contemplates sequencing multiple phases of development of the unsecured border over multiple years, with a goal to complete as much of the wall as possible in the shortest timeframe.


Description

i) After the Disaster Declaration referenced above, $250 million was reallocated from the current budget as “a down payment to launch construction of a border wall.”  Program development is ongoing, and the Program Manager(s) will play a key role in facilitating the Program’s final composition. More than one Program Manager MAY be awarded.

        (1) Planning and programming of TBW including developing the total program and individual project budgets, options, and recommendations for the most effective and efficient wall alignment, with locations for supporting infrastructure including but not limited to access roads for maintenance and patrols, gates, infrastructure for monitoring equipment (cameras, intrusion detection, etc.), lighting, etc. 

        (2) Collaborate with State agencies and local officials to develop innovative approaches for land access for construction.  Develop a streamlined coordination and approval process for land access and utilization, to include all categories of landowners. Manage all procurement and approvals for land use as necessary to support completion of the program in the most cost effective and timely manner.  Acting as an agent for the State, negotiate all land use agreements and prepare documentation for final approval.

        (3) Determine the sequence of construction projects and phase completion to balance operational priorities and budgets with efficient and effective construction execution.  Collaborate with appropriate stakeholders to develop execution options for consideration by senior Program decision-makers. Coordinate the TBW development plan to integrate new construction with sections of the current Federal border control systems.  

        (4) Make recommendations for project procurement and delivery methods, to include potential alternative delivery methods. Develop separate “Projects” for procurement and management best suited to effectively expedite completion of the overall Program. The Program Manager(s) may help facilitate the procurement process in conjunction with TFC and shall follow all State procurement statutes.

        (5) Coordinate the design requirements of the TBW for full compliance with the most current version of the Customs and Border Protection – Tactical Infrastructure Design Standards.

        (6) Oversee and manage all separate TBW “Projects” and efforts to ensure adherence to all Authorities having Jurisdiction including but not limited to TFC Requirements and State of Texas laws and regulations.

ii) No construction is contemplated as part of this solicitation for professional services.

c) Scope of Work:  The Program Manager(s) will work closely with TFC to lead a lean and owner-centric collaboration with stakeholders, including State agencies, Architectural / Engineering / Construction (AEC) contractors, subcontractors, consultants, and other 3rd party entities during the development, design, construction, and close-out/warranty phases of the program, as described in Attachment A – Program Management Professional Agreement, and as described herein.  Specific tasks will include, but not be limited to:

i) Provide individual and corporate expertise in the oversight and control of a program with similar scope, magnitude and complexity and including but not limited to extensive experience in providing leadership and direction in projects using advanced technical construction applications and methods.  

        (1) Demonstrate experience, expertise, and capacity in developing and managing a robust program/projects communication plan and protocols, including community outreach.

        (2) Demonstrate experience in land access and right of way development to include mineral rights, easements, deed restrictions and reservations, reversion clauses, conversion, other considerations that limit land use and conveyance, research analysis, negotiating land use agreements (easements, leases, etc.) and preparation of real estate documents. A Geographic Information System (GIS) mapping capability is desired. 

        (3) The Program Manager should be well versed in state and federal laws and regulations related to state and federal property and natural resources.  This expertise should include familiarity with statutes and regulations related to state and federally-listed threatened and endangered species, jurisdictional wetlands and navigable waters, water quality, environmental assessments and impact processes, cultural and archeological resources, international treaties, and tribal consultation processes.

        (4) To accomplish the site and infrastructure work, the service of a firm experienced in managing contracts of firms performing site design and Land Development Engineering (LDE), either as prime contractor or subcontractor, is desired.

        (5) The Program Management team will collaborate and work with full transparency with TFC Program Leadership and may be subject to open records requests as defined by the Freedom of Information Act (FOIA).

        (6) Scopes issued under resulting TFC issued contract(s) will encompass all aspects of planning, site development, design and the site integration of all infrastructure, utilities, utility providers and facilities.

        (7) Site, infrastructure, and the primary facility design and construction work will typically be accomplished by separate contracts issued by TFC which the Program Manager(s) will oversee.

ii) Provide full-time accounting support personnel to work directly with the TFC Finance Department.

        (1) Experience managing multiple sources of appropriated funds, and lines of accounting including state, federal, grants, and private funds. Subject to full audit.

        (2) Experience with Grant Administration.

iii) Prepare a program controls management plan (PCMP) to include, but not limited to:

        (1) Planning and programming;

        (2) Property procurement and accessibility;

        (3) Working with TFC's design professionals in scoping and scheduling of design, including but not limited to appropriate design phases for review and approvals, complete construction documents including all required documentation for all Authorities having Jurisdiction approvals;

        (4) Cost;

        (5) Schedule;

        (6) Scope;

        (7) Risk;

        (8) Communications;

        (9) Quality. Provide oversight of a robust CM/GC led QC program that considers all aspects of quality from code compliance and all State policies and applicable laws from the programming phase through the commissioning phase; and

        (10) Safety. Develop for TFC approval and oversee a comprehensive safety program to ensure adherence by all participating TFC contractors and subcontractors through the life cycle of the program.

iv) Demonstrate experience, expertise, technical competence, and capacity in the type of work required to ensure successfully implementing, coordinating, and managing a state-of-the-art program control process throughout the projects’ life cycle, and provide methodology for ongoing quality, cost, and schedule control measures.

        (1) Constantly monitor and routinely report on the projects’ scope, budget, schedule, and performance consistent with TFC goals and objectives.  Ensure appropriate personnel are located in the geographic area of the project(s) with knowledge of any local requirements in addition to all Program level requirements.

        (2) Document, map and monitor review and acceptance protocols for project design.

        (3) Review and become knowledgeable with the TFC Owner’s Project Requirements to ensure project compliance.

        (4) Employ lean project principles, processes, and best practices to promote more reliable, precise, integrated, and cost-effective contract management of design and construction solutions, including managing your team’s efforts and cost.

        (5) Develop strategies to forecast and aid in impact mitigation of external and internal factors on project performance.

v) Demonstrate experience, expertise, and capacity in developing and forecasting accurate cost estimates based upon current local market conditions, and trends.

        (1) Track project budgets and estimates during the projects’ life cycle, and provide reports as appropriate and requested by Owner to maintain control.

        (2) Evaluate and scrutinize project cost estimates and reconciliation through collaboration with the project team at regular project intervals.

        (3) Provide official recommendations to TFC related to cost estimates, Guaranteed Maximum Price (GMP) submissions, Value Analysis, etc. within the Program.  Include in such recommendations any impact to the projects and overall program related to cost, schedule, and reporting to the public.

        (4) Track program and project costs throughout the projects’ life cycle providing reports as appropriate and as requested by Owner to maintain optimal control and in accordance with TFC Finance Department and all other stakeholders.

vi) Demonstrate substantial knowledge and ability to develop, assemble, review, evaluate and scrutinize project schedules and forecasts including status reporting and communication through earned value management.

        (1) Incorporate and analyze fragnets within the project schedule affecting review, approval, administrative, and other processes.

        (2) Monitor and compare the projects’ design and construction baseline and all subsequent schedules utilizing all approved and recognized process optimization protocols.

        (3) Provide monthly Program schedule updates including narrative describing potential risks to specific project’s success and any impact to other projects and the overall program.

        (4) Manage meetings and related reporting with TBW stakeholders to review progress and track project execution.

        (5) Participate with project teams in developing mitigation plans for regaining project conformance.  Ensure approved mitigation plans are incorporated in the appropriate projects, monitor and report to TFC Leadership regarding progress, or lack thereof, on a weekly basis, or more frequently as deemed necessary. 

        (6) Provide recommendations to TFC regarding appropriate action regarding failed or lagging mitigation plans for any specific projects. 

vii) Demonstrate substantial knowledge and ability to develop, evaluate and make recommendations related to alternative financing methods, such as Public-Private Partnerships (P3), bonds, and other collaborative funding methods.

viii)  Management of 3rd Party Document Peer Review Services

        (1) Manage services for review the following to address completeness, coordination and constructability of the design deliverable packages and documents.

(a) Structural Systems;

(b) Utilities, Civil, H&H, and Site Development;

(c) Electrical, Low Voltage (IT), Control and Surveillance Systems;

(d) Data and Telecommunications, 5G, and Cyber Security;

(e) Fire and Life Safety Systems; 

(f) Special Systems including associated work related to each discipline (phasing, demolition, excavation, controls, site lighting, etc.);

(g) Environmental Engineering.

        (2) Manage review services for contract documents and compile written action item check lists/reports provided from initial review and updates at each milestone deliverable.

        (3) Perform independent construction cost estimates of design deliverable packages and change proposals:

(a) Participate in cost estimate reconciliation with the project teams and;

(b) Manage a value engineering process to aid project teams in cost reduction, schedule streamline, and/or material and system substitution. 

ix) Review consultant and contractor progress payment applications.

x) Review and analyze contract modifications and negotiations.

xi) Review quality control and compliance programs.

xii) Establish and manage communication plan and public outreach efforts.

        (1) Establish project communication and information management system which provides all participants real time access to project information and communication; provides organized methods of information archival to facilitate retrieval when needed.

xiii) Demonstrate experience, expertise, and capacity in monitoring the effectiveness of construction administration services to be provided by the PM, A/E firms, or Design Builder, and other service providers for the projects.

        (1) Provide construction management services to include assisting TFC on the scoping and delineation of services for independent and 3rd party inspection services.

xiv) Responsibilities shall also include:  monitoring and managing design progress schedules; safety control and compliance systems; monitoring construction; creation, review and analysis of reports, manuals, standards, testing reports, commissioning reports, and training services; and possible assistance in negotiating contracts for labor, material, and services associated with the project.


CONTRACT TERM: This service shall be for a period beginning on the date the contract, as defined below, is executed by both parties, and shall expire on September 10, 2026 unless renewed. Any extension or renewals shall be in writing and at the same terms and conditions, plus any approved changes.

i) The Pre-Proposal Tele-Conference is scheduled for August 5, 2021, 3:00 PM CDT

ii) Pre-registration for the pre-proposal tele-conference is required. See RFP document for registion link.

iii) Attendance of the scheduled pre-proposal tele-conference is recommended. Please do not be late.  The recording of the tele-conference will be posted after the meeting. 


SCHEDULE OF EVENTS: TFC reserves the right to change the dates in the Schedule of Events set forth below upon written notification to prospective Respondents through a posting of an addendum on the ESBD. The solicitation process for this RFP will proceed according to the following schedule:
